The ATF letter says marijuana users are prohibited from \u201cshipping, transporting, receiving or possessing firearms or ammunition.\u201d<\/p>\n<\/div>\n<div class=\"text\">\n<p>Anyone applying to purchase a gun from a licensed dealer must sign a form attesting he or she is not \u201can unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance.\u201d<\/p>\n<\/div>\n<div class=\"text\">\n<p>\u201cWarning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside,\u201d the form notes.<\/p>\n<div class=\"text\">\n<p>Lying on the form is a felony under federal law, punishable with up to 10 years in prison.<\/p>\n<\/div>\n<div class=\"text\">\n<div class=\"text\">\n<p>\u201cThere is definitely a conflict between the state laws and the federal laws,\u201d said Joe Eaton, southwest Ohio spokesman for the Buckeye Firearms Association.<\/p>\n<\/div>\n<div class=\"text\">\n<p>It\u2019s not clear how to reconcile that conflict, he said, \u201cWe are confused as everyone else at this point.\u201d<\/p>\n<\/div>\n<div class=\"text\">\n<p>When Ohio\u2019s medical marijuana program becomes operational in September 2018, Ohioans will be able to register to use cannabis if they have a recommendation from a physician saying they have one of 21 qualifying conditions.<\/p>\n<div class=\"text\">\n<p>Industry analysts have estimated as many of 24 percent of the state\u2019s population \u2013 or about 2.8 million Ohioans \u2013 have a qualifying condition.<\/p>\n<\/div>\n<div class=\"text\">\n<p>The conflict between federal firearms laws and state cannabis laws has flared up on other states.<\/p>\n<div class=\"text\">\n<p>In Hawaii, Honolulu police last month told residents who had medical marijuana cards they have 30 days to turn in their firearms to authorities,\u00a0<a href=\"http:\/\/www.staradvertiser.com\/2017\/11\/28\/breaking-news\/honolulu-police-tell-legal-marijuana-users-to-turn-in-their-firearms\/\" target=\"_blank\" rel=\"noopener noreferrer\">according to reports in the Honolulu Star Advertiser.<\/a><\/p>\n<\/div>\n<div class=\"text\">\n<p><a href=\"https:\/\/apnews.com\/bbb3ef37357d4799bec33cb2d36a7bae\" target=\"_blank\" rel=\"noopener noreferrer\">The Associated Press reports<\/a>\u00a0that a federal circuit court of appeals ruling on a case out of Nevada found that the federal ban on the sale of guns to medical marijuana users doesn\u2019t violate the Second Amendment.<\/p>\n<p>retrieved from:http:\/\/www.daytondailynews.com\/news\/crime&#8211;law\/guns-ohio-medical-marijuana-users-won-able-have-firearms\/th1VxfawP7LNhFikF34ZTO\/<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>No guns: Ohio\u2019s medical marijuana users won\u2019t be able to have firearms People who register with the state of Ohio to legally use medical marijuana will be prohibited from possessing firearms under federal law, according to guidance released by the U.S. Bureau of Alcohol, Tobacco and Firearms.
